Buffalo State College does not condone the use, sale, or possession of illicit drugs or underage consumption of alcohol on its campus or by its students. The College offers a number of programs to inform and educate students about the effects, dangers, and consequences of drug or alcohol policy violations.
Students should also be aware that the College will vigorously prosecute students who violate provisions of the Code of Student’s Rights, Freedoms, and Responsibilities through abuse of alcohol and other substances. Behaviors that are detrimental to the learning environment and/or damaging to the reputation of the College (whether occurring on or off of college property) will not be tolerated.

Under the College's Code of Student's Rights, Freedoms, and Responsibilities, Section VI. C.7 expresses that such behavior by current students may be cause for disciplinary action.
Possible legal sanctions that may be applied by a court under state, local, and federal law:
-Conditional discharge of a case
-Court mandated programs
-Probation
-Up to 1 year in jail
-Fines up to $1000

Furthermore, it should be known that federal law provides that a student who has been convicted of an offense under any federal or state law involving possession or sale of a controlled substance during a period of enrollment for which the student was receiving financial aid shall not be eligible to receive any federal or institutional grant, loan, or work assistance during the period beginning on the date of such conviction and ending after the interval specified below:

First Offense: 1 year
Second Offense: 2 years
Third Offense: Indefinite
The Sale of a Controlled Substance, ineligibility period is:
First Offense: 2 years
Second Offense: Indefinite
A student whose eligibility has been suspended based on a conviction for possession or sale of a controlled substance may resume eligibility before the end of the ineligibility period if:
1. The student satisfactorily completes a drug rehabilitation program that complies with the criteria prescribed in the federal regulations and includes two unannounced drug tests.
2. The student successfully passes two unannounced drug tests conducted by a drug rehabilitation program that complies with the criteria prescribed in the federal regulations; or
3. The conviction is reversed, set aside, or otherwise rendered nugatory.
